Description of Proposal
The Official Plan Amendment application seeks to create a Secondary Plan for the White Church area. The application states that the Secondary Plan would accommodate a range of residential, commercial, institutional, and open spaces uses at varying densities. The proposed minimum residential unit count for the Secondary Plan area is 4,836 units at 22 units per hectare.
It is important to note that Bill 150, the Planning Statute Law Amendment Act, 2023 received Royal Assent on December 6, 2023. This Act had the effect of deeming previous Ministry of Municipal Affairs and Housing modifications to the Urban and Rural Hamilton Official Plan that brought these lands into the Hamilton urban boundary as never to have been made.
This means that these lands are not within the urban boundary. The lands would need to be brought into the urban boundary before the Secondary Plan application is considered.
Application Status: The City of Hamilton deemed the application incomplete on January 12, 2024. The decision to deem the application incomplete was appealed to the Ontario Land Tribunal under Section 22(6.2) of the Planning Act on February 9, 2024 by the applicant.
