I am requesting an appointment with Alex Wilson, Ward 13 Councilor, to discuss the following concerns, which were sent via email to his office on February 20th, 2025 without response:
I have been working tirelessly with my Building Consultant, Maged Shireen (with whom Alex Wilson assisted on 74 Best Av) toward submitting a Building Permit for several months. The City continues to request additional information, including recently involving the Conservation Authority, which has delayed our intended timeline.
When my Consultant, Maged, approached the Building Department to submit our application on January 30, 2025, it was only then that a Conservation Permit was also requested. Since then, he has been in continued communication with the Conservation Authority to submit an application as quickly as possible.
As a result, and in the meantime, we have received/paid fines and had inspection fees added to our property tax roll for having an unregistered vacant building. As we were in the process of preparing a building application for submission as soon as possible, we were told we would be exempt from this registration by continuing to provide progress updates to the by-law officer. We have provided such updates regularly and Maged has extensive documentation (such as architectural/structural plans, HVAC and trusses) as evidence of our serious efforts to prepare and submit a building application.
Furthermore, it was also explained to the officer that the property consists of a single dwelling, with no utilities, making it uninhabitable. We appreciate the City’s need for more housing and its rationale for implementing fees and taxes on vacant properties to quickly create additional housing. The current building does not fit the criteria of a dwelling that could be inhabited. We are trying to help the City’s initiative by creating 3 new housing units in place of a building that is not inhabitable (and within the same footprint), a substantial improvement to the property, but seem to be getting delayed and penalized in the process.
Also as a result of delays, we have encountered repeat trespassers/vandalism, requiring us to secure the building on several occasions and a neighbour, who is upset we would not sell the property to her, has filed complaints about the trespassing and vandalism.
Despite our hard work and efforts to co-operatively work with all parties to significantly improve the site and create more much-needed housing, we are threatened with more penalties from the City for delays that only the City can control. We trust you understand our frustration.
Specifically, these fines/fees began on January 20, 2025 and to date total approximately $700 and imply these fees could continue at a rate of $700 every 2 weeks.
Maged is prepared to submit the Conservation application within approximately 10 days and is prepared to submit the Building application concurrently if allowed. We would appreciate your assistance on this matter. In the meantime, we hope for your assistance regarding the ongoing inspection fees and fines being issued.
A meeting/discussion with the Councilor would be greatly appreciated. Thank you in advance for your consideration and attention to this matter.
