Battle of Stoney Creek Volunteer Registration

I, and any other party claiming an interest through myself (including, without limitation, my minor child(ren), my heir(s), my spouse, my beneficiaries, my parent(s) or legal guardian(s), my executor(s), my administrator(s), my successor(s) and my assign(s), as the case may be (hereinafter referred to as “my dependents” or “I/we”):

• (i) hereby acknowledge that battlefield re-enactments and activities related thereto are hazardous activities and I/we have the necessary physical health, knowledge, experience, equipment and ability to competently and safely participate in the Re-enactment of the Battle of Stoney Creek (the “Event”);
• (ii) hereby release, waive and forever discharge the City of Hamilton, including, without limitation, its elected officials, its employees, its agents, its subcontractors, and its successors and assigns (collectively “the Parties”) from all claims, suits, losses, liabilities, obligations, judgements, costs, actions/causes of actions, damages and expenses (including legal fees and disbursements, settlements, awarded damages and court costs) etc., whether in law or in equity, in respect of death, injury, loss of or damage to my (and/or my dependents, as the case may be) person or property (real or personal), howsoever caused, arising or to arise by reason of, relating to, or in connection with my (and/or my dependents, as the case may be) participation in the Event, whether prior to, during or subsequent to the Event (for greater certainty, the City of Hamilton acknowledges and agrees that the release/waiver provisions set forth in this subsection (ii) shall not apply to situations where such claims, suits, losses, obligations, judgements, costs, actions/causes of actions, damages and expenses have been finally determined to have resulted directly from the gross negligence of the Parties);
• (iii) hereby acknowledge that I agree to abide by the rules and requirements outlined during the mandatory Training Session provided to me in advance of the event.
